[Should grandparents or foster care providers be the states first choice for placement when children are removed from their parents' custody?]

Even then the social workers said that the parents did it and when they had supervised visits they would break there sons arms. The whole story was barbaric and even after doctor after doctor would tell the social workers that the parents are not doing it that it was the disorder, they did everything in there power to keep the son away from there very innocent parents. A few years later the family got there son back after the court ruled that "the parents showed to have changed and gone through the parenting classes successfully". There was more to the story but it was just completely barbaric that anyone could do this to a child and his family with no sign that there was any type of abuse.

In a lot of those cases the Grandparents had the kids at one point.

I think there should be qualifiers for the grandparents, just like there is for foster parents. Maybe even the same training and requirements. I have seen too many cases where the kids went to live with their grandparents and the same thing happened. (some times worse)

Yet I do agree that the grandparents/relatives should have the first shot at the child.

Working for an agency that has foster care and residential programs I have seen my share of what some parents can do, and it never fails to shock me what some can do.

Any suggestions on what I can or should do about this?

the other removals are for alleged neglect which is more often then not poverty. The ones that are so often trumpeted in the media are the exception not the rule.

For you to state that blood relation matters more is wrong. Do what is best for the child. Don't hang on to these vague and wishy-washy concepts of "keep it in the family." My 3 y/o daughter was brought to us when she was 4 months old. She was malnourished and failure to thrive. Parents could not tell the social workers when the last time she ate. However, a simple home visit and a little common sense should suffice for a temporary placement. If an investigation is done, it should again use common sense. Instead they drag in ridiculous old history that had nothing to do with child neglect or endangerment. If they put our USA Presidents through such rigorous investigations, we would not find anyone clean enough and if we did, they would have to give up their children after the investigation because they would fail CPS rules to be a parents Also, I might add that foster parents are not scrutinized to the same level as biological parents.
Having a child drop out of school at 16 years old is not child neglect. Anyone ever tried to make a sixteen year old go to school? This excluded one grandparent!

I am not the biological mother of my daughter but her biological mother chose to abandon her. I brought this child to visit her every single day and she would show up so out of it on drugs with track marks on her arms and shaking so bad she couldn't hold the baby. Her mother was with her and was the same. Did you catch the part about my daughter having brain damage because of the drugs and alcohol her mother took while pregnant??? I didn't need a social worker to tell me that, I live with it everyday.

Also before being kidnapped by the state, just before his 10th birthday, he had visited Disney World, Disney Land, Sea World, The World Famous San Diego Zoo, The Wild Animal Park, Niagara Falls, The Hoover Dam, Las Vegas, climbed Lady Liberty in NY, visited the top floor of the Sears Tower in Chicago, and had taken TWO cross country trips, and was headed to Hawaii before being kidnapped, just to name a few. He had been involved in boys gymnastics, tennis, piano and guitar lessons, chess, studied French and Spanish, lived in a gated community with a pool and Jacuzzi, above average in EVERY subject, straight A’s in private NOT public school, perfect attendance for years in school, etc. He was always impeccably dressed, because after all he is a reflection of me, to include professional hair cuts weekly at the barber shop. He had excellent private medical and dental coverage, and was not on public aid. He had BOTH a mother and father working to care for his every need. And most importantly, he has a mother that loves, adores, treasures, and cares for him like no other child I know. I could go on and on … but I think you get the picture. So although you, and people like you, feel a need to SAVE THE WORLD, your help is not always needed … nor wanted. There is a lot more that I would like to say but will refrain. By the way, my son was also “abandoned,” because “I didn’t want him.”

As far as your personal attacks on me, I will not dignify them with a response; because you would have to KNOW ME in order to intelligently and convincingly speak on what I think or feel. In the future if you would like to debate the issues of foster care and forced adoption, your argument would be more effective if you stuck to the facts and not allow emotions to get the best of you. Until then, I will be waiting for you to state verifiable facts and statistics.

Cy Wrote: I dont think it is fair to put children in foster homes. I think they should let the relatives step in first. I know this because my children were taken from me in October 2005 just because i didnt pick them up from school on time they were put in foster care and they were abused from the foster parents and no one did anything about it. I even told the police and they did nothing, and my worker did nothing to help me at all. I am working on a law suit for Lassen County because of all the abuse that happened to my 3 and 5 year old babies. One was punched in the mouth for sucking her thumb and the worker knew about it. My 5 year old told her what happened and she called her a liar right in front of me and my husband. So much has happened to them, and i feel so bad for them. This isnt the end for CPS -- they will always ruin families and homes as long as they can; And i think it is time that all the parents stand up and fight all the wrongdoing done by CPS. Lassen County is really bad -- they do nothing but take children from parents just so they can get a check at the end of the month. CPS should weed out the stupid calls and get to the really bad ones; but they tend to worry about the little stuff and ignore the big stuff. For example, what about the lady that threw her kids off the San Francisco Bridge -- her family told CPS about this and they did nothing and this became a really big deal. CPS worries about parents that spank their children instead of the parents that are threatening to kill their kids. CPS in San Francisco was told a week before the mother threw her children over the San Francisco Bridge in order to feed them to the sharks what her intentions were but they said there was no reason to take the children -- and now look three children are dead because CPS was worried about the minor crap instead of the real stuff.

the scenario that you mentioned has to have too many factors in it for someone to be wrongly accused and a child taken. That is why the numbers are so different.

This issue is far too serious of an issue to get hung up on what I think or what you think, the statistics speak for themselves and facts are facts. I can tell you this with in the agency that I work for in foster care we have more whites than blacks and latinos, right now. Also we are getting children 3 and 4 at a time due to Meth. Almost daily we get a call looking for a family that can take some kids taken from a meth home.

In fact one of our regions has split 2 times in the last 18 months due to the expansion needed for kids taken from Meth houses. Overwhelmingly they are white.
ALWAYS the kids are innocent. But what is the abomination is when daddy gets drunk or high and mama doesn't stop him from burning or kicking little Billy.
95% of the time where there is smoke there is fire. It is just sometimes CPS goes in with a water tanker when they need a squirt gun. But like I have said before, for every case that turns out a mistake was made, there are dozens and dozens that weren't.

You talk about stats and facts let me see those to evaluate them for myself.

As far as stats are concerned, a simple trip to your local library or a quick internet search would really open your eyes to what is truly taking place behind the veil, if in fact you are truly unaware.

Also … when you decide to do some independent research, you may want to start in Milwaukee County. Although White children, countywide, outnumber Black children at a rate of nearly 3 to 1 … Black children outnumber White children in the foster care system 7 to 1. Perhaps you can explain this to me? And in Minnesota Black children are more than 16 times as likely than White children to be removed from their homes … why? Could it be the same reason Blacks are arrested and/or thrown in prison more than other races of people? Whether you want to accept it or not, racism is still very much alive and well!

Which is the case in less then 3% of the removals in the U.S. However, Children are per capita five times more likely to be killed in foster care, fifteen times more likely to be sexually abused, but only twice as likely to be neglected, this information though comes from only about 2 thirds of the states. If the information from all the states and territories were factored in they would go higher. Yes the children are innocent, That is why due process of law requires removals only when there is evidence that the child's life is in danger or severe harm may result simply because the very effect of removing the child causes severe mental and emotional trauma to said child.

During meetings in Arizona to support SB1430 A bill to increase evidence needed for removal to the same as employed for native american children and create an independent investigative body to check up on CPS several case workers were worried about their jobs and stated by "requiring real evidence we will not be able to remove most of these children". They wouldn't answer some parents question on what they meant by real evidence. The investigative body not under their control scared them senseless.

just out of curiosity, were you aware of the following federal law
Sec. 242. Deprivation of rights under color of law Whoever, under color of any law, statue, ordinance, regulation, or custom, willfully subjects any person in any State, Territory, Commonwealth, Possession, or District to the deprivation of any rights, privileges, or immunities secured or protected by the Constitution or laws of the United States, or to different punishments, pains, or penalties, on account of such person being an alien, or by reason of his color, or race, than are prescribed for the punishment of citizens, shall be fined under this title or imprisoned not more than one year, or both; and if bodily injury results from the acts committed in violation of this section or if such acts include the use, attempted use, or threatened use of a dangerous weapon, explosives, or fire, shall be fined under this title or imprisoned not more than ten years, or both; and if death results from the acts committed in violation of this section or if such acts include kidnapping or an attempt to kidnap, aggravated sexual abuse, or an attempt to commit aggravated sexaul abuse, or an attempt to kill, shall be fined under this title, or imprisoned for any term of years or for life, or both, or may be sentenced to death.

It does apply to case workers, at least in the ninth circuit, so it behooves all case workers to know what a families constitutional rights are. 8-) After all, we live in an era of "ignorance of the law is no excuse."

The Goodbye Meeting

[When Nothing You Do Seems to Matter]

I am submitting my personal story because I want the world to know what is happening to my family and countless other innocent families in Kentucky.

I am the maternal grandmother of five siblings. However, as of July 6, 2006, three of my five grandchildren have been permanently taken from my daughter. The Inspector Generals Office led us to believe they were investigating our case; but after continuously trying to get them to at least acknowledge our inquiries, we ran out of time … this, of course, we believe was the plan to begin with. We were given false hope when a local news channel took an interest in our story until we saw photographs of the girls on our television screen -- which were pictures that I provided to the social workers. The pictures displayed were photographs of the twins at around 4.5 months of age. Viewers were led to believe they were looking at 13-month-old starving twins! It was also reported that the girls could not sit up or crawl at 13-months of age. Nevertheless, I have recorded video of the girls happy, well adjusted, crawling, sitting up, and singing at 10-months-old; but no one would listen to us.

I have the older two siblings but the younger three girls are in foster care and are about to be “adopted-out.” I have no background issues to prevent me from welcoming all five children into my home. As a matter of fact, my home has been evaluated and passed inspection or I would not have been approved for placement of the two older boys … ages eleven and nine.

A foster family has the three girls and a foster grandmother is caring for them. I am not giving up the fight for my grandchildren! I have been fighting the state for three years now to obtain custody of the three girls AND WILL CONTINUE to fight this injustice! I am their biological grandmother, the boys and girls need to be together -- Additionally, I am capable of raising them all. A social worker and therapist told me yesterday, that they would arrange a “goodbye meeting” between the girls, boys, mom, dad and myself. After this goodbye meeting, we will never be able to see the girls again. The girls are identical twins, ages five in September, and their youngest sister will be four-years-old also in September. They are gorgeous girls and any and everyone would love to have these girls … they are cute, young and ADOPTABLE! The boys are cute also, but they are older children … ages eleven and nine and not as “adoptable” – THANK GOODNESS!

My daughter has been falsely accused of neglect. She has a slight learning disability but nothing that would be detrimental to the care of her children. She has a form of Dyslexia. She is threatening a nervous breakdown … as are her five children. The state has done everything to ensure that she will NOT succeed … but little to nothing in assisting and reuniting her with her children. The state would rather pay strangers $2,500.00 per month and receive state bonuses or incentives rather than do the right thing for this family. My daughter is poor and therefore has become a prime candidate for the system. The social worker intentionally developed case plans that were practically impossible to follow. Sometimes, two and three meetings were scheduled per day although my daughter has five children!

The girls have already been in two abusive foster homes. My youngest grandbaby nearly died at the hands of the first foster “mother.” She had to be rushed to the hospital from the Doctors office and put on a respirator. Nevertheless, the social worker continued to allow this woman to keep these children in her home for another year! One of the twins had her arm pulled out of socket TWICE by the foster “mother.” They have continuously had unexplained bruises and scrapes.

I was threatened and informed that if I ever attempt to visit the twins' school again I would be arrested. I simply visited the school to speak with the twins’ teachers about issues that had been raised in court regarding statements made by them. I also wanted to let the school know that these children ARE NOT orphans and I DO WANT THEM, if their mother cannot have them. They are important members of our family unit and deeply loved. The children love me as their grandmother and know that I am their family. Three teachers at the school were under the impression that the children did not have any family members willing to come forward to take them. They were a bit set back and shocked by my appearance and desire to take the children. The social worker became livid when she learned that I went to the children’s school! She said I had no right to go there and that if I showed up again, the school would call the police and I would be arrested. Although there was never a court order nor was I informed that I could not go to my grandchildren's school.

I NEED HELP! I have Doctors reports, pictures and documentation, ready to present to anyone that will look at them. The state and Judge refuse to look at this evidence and want me out of the picture! I have been threatened by the social worker on three occasions. I have written a letter to the Ombudsman to request an investigation – this although the social worker stated that I could not do that. I was strongly advised that if I continue with “this type of behavior,” she would make sure that Chris, age eleven, would be removed from my home. The second threat was the same. She accused me of telling my youngest granddaughter that she was coming home with me which I would NEVER raise her hopes like that. These children are suffering immensely! They always TELL ME they want to go home with me NOT the other way around. The social worker even went as far as to say “I hope you did not say that to this child or I will take the two boys back!” It is impossible that I could have said these things because the girl’s visits are supervised and never have I had anytime alone with them to say these things.

My daughter has been incarcerated because her second son ran away on his bicycle and they charged her with endangering a minor. This child is now in a group home, per the states request. At the age of nine, the child was reeling from a drug that the state therapist and state psychiatrist had prescribed. He has never been truly diagnosed with bipolar disorder but he is being given medication for this at the group home. He is allowed to come to my home with his older brother on weekend passes but still remains in state custody. Can you believe the state has prescribed LITHIUM to this nine-year-old boy! Once prescribed, no one followed up on his lab work. They accused my daughter of not having the lab work done, but it later turned up after we went on a scavenger hunt to find the paperwork. This medication affected his entire body and mind. One of the side effects from this medication is developing thyroid problems. He even began hallucinating and threatening to kill himself or his brother. So he was thankfully admitted to a REAL hospital with REAL physicians. The on call psychiatrist was stunned to learn that his thyroid was 11.5 which is extremely out of range! We were advised that at this range, the child could experience numerous reactions and problems … to include attempts at suicide, hallucinations, organ damage … and even homicide! Yet the Cabinet for Family Services (CFS) never checked his blood work! My grandson is being used as a little lab animal at this facility and by the state of Kentucky! When he peddled off on his bicycle, my daughter had the other four children with her while taking care of the children’s paternal grandmother, who was dying. She was walking down the driveway with all four children when the police approached and returned my grandson to his home. They issued her a citation to appear in court where she was charged with criminal abuse on a minor. They sent her to jail so that she would be unable to attend scheduled appointments and meetings. I often wonder if she had left the other four children at home to look for my grandson would the outcome have been different. I speculate that something worse could have very well happened to one of the other children, if she had left them to look for the other one.

We plan to appeal the judge’s decision but I feel that this too will be an uphill battle. There are reports already circulating that the appellate court attorney may not be able to obtain the court tape from our trial. I can tell we have our work cut out for us.

The state of Kentucky is currently being investigated for knowingly putting children in harms way by rushing them from foster care to adoption too quickly. According to published reports, social workers and child protective service agencies are receiving monetary bonuses when children are rushed from foster care to adoption. Unfortunately, there is so much more to this story that would SHOCK the world as it does me. So if you are reading this thinking this could not have REALLY happened … believe me, it can happen AND IT DID! If you believe that Child Protective Services (CPS), DCFS, CFS, DSS, etc. are here to “protect” children … THINK AGAIN! They are no more than a black market, baby selling ring!

Yes, there is child abuse in our world but the government or SOMEONE must hire individuals trained to know the difference. These trained and caring individuals must truly serve the well being of families … and not their own greedy agenda! This is a money game for most of them and they do not care if your child or grandchildren are abused while in their care. Whoever has the most money to pay off the courts … wins the prize, which is our children!

We MUST reform the child “welfare” system!

QUESTIONS TO THE PUBLIC: Why is the biological grandmother being denied the opportunity to care for three of her five grandchildren? According to the social worker, caring for five children would be too much for her to handle. Nevertheless, child protective service agencies REPEATEDLY and consistently place large groups of children in individual foster homes everyday! So I ask you, why are foster parents allowed to care for and subsequently adopt 10 or more children when THIS grandmother is not allowed to care for five? Not only are foster parents allowed to care for and adopt large groups, but biological parents are also caring for and raising their own large families. On a personal note, my mother is one of 10 children born to the union of my grandparents.

When my oldest daughter was about 7 yrs old she wanted to get her first LP -- She picked Twisted Sister. Personally, music has always been very important to me. I think of a lot of songs that touch this situation with our children being gone from us. Harry Nilsson's Without You, Conway Twitty's That's My Job, all awesome words. Twisted Sister's We're Not Gonna Take It, is US. Twitty's "That's My Job" is about his job being to take care of his child. Nilsson's Without You makes me cry, I don't listen to it these days. When news of sadness gets us down, such as tonights news of the precious child lost (see http://www.latimes.com/news/local/la-me-crash1jul01,1,6260379.story?ctrack=1&cset=true) we must remember that We Aren't Going To Take This and We ARE Going To Get Our God Given Jobs BACK of Raising OUR Own Children.

I was actually thinking of approaching things from a different point of view...being wrongfully "fired" from our jobs. Raising a child is the highest calling and takes the utmost love, understanding, strength and character. Obviously this "job" is being given to the less competent. I wonder what the Labor Board would do if they were bombarded with request for help because of parents losing their rightful job of raising their kids. They may not be able to do anything since it's a labor of Love and not dollars. But with enough request for assistance, it sure would get some attention!

Life Goes On ...

[My Condolences to This child's Actual Mother and Family]

Well today is Friday, June 30, 2006 and while preparing to contact Oprah, Montel, Dr. Phil, and ABC News affiliates ONCE AGAIN, NBC4 News here in California just reported the death of ANOTHER foster child killed while in the "protective" custody of our state.

In an attempt to bring awareness to the silent and often shameful pandemic ravishing our nation ... which is foster care and juvenile court injustice, I have intentionally and consistently contacted the aforementioned talk shows REPEATEDLY. Now that foster care awareness has officially come to an end, I guess I will give Oprah, Montel, and the other powerful forces of main stream media a much needed break from my rants. Nevertheless this vicious, out of control, loosely manned, unconstitutional and criminal organization that is foster care/Child "Protective" Services must be stopped!

Just curious ... will the state NOW charge the foster "mother" with neglect due to her inability to supervise and therefore protect this child? Will she be charged for allowing this baby to ride her tricycle at night, in the street, without adequate supervision? The last time I checked MTA buses operate on city streets ... not sidewalks! So it goes without saying that this child was riding her tricycle, unsupervised, on a city street. According to a witness, the toddler did not have brakes and “… she rode down the hill, right in front of the bus …” (see: http://cbs2.com/local/local_story_181022843.html). I guess we will have to wait to find out why she was initially removed from her home and her mother's care to begin with -- I sure hope it wasn't dirty dishes!

While watching one of the video links above I noticed that NBC4, in its report on the now deceased toddler, sent condolences to the foster "mother." Never once were sympathetic words sent to this child's biological mother, father, grandmother, aunts, uncles, and the extended family members and friends who undoubtedly fought for custody of this child but was probably denied. I am sure that her family fought for custody prior to the states decision to place her in the home of strangers -- just as my family fought for my son, but was "denied." How incredibly sad!
I can only imagine the anger and rage this child's actual mother and family must be feeling right now. Yet another name to be added to the tomb at www.fixcas.com/parody/tomb.htm.

Unfortunately this child's story has been reported, people have discussed it, she will be added to several statistical lists, and life goes on! I wonder when life will stop just long enough for us to realize that THIS MUST STOP! Our government must immediately put an end to supporting the rape, murder, molestation, abuse and neglect of innocent children. Our government must immediately put an end to supporting the destruction and slaughter of American families and often innocent lives. Until our busy lives slow down just enough to examine, correct, and eliminate the corruption and injustice within our family and juvenile courts, parents like myself will continue to work tirelessly. We will continue to fight and SPEAK OUT about this gross injustice!

KNOW THIS CHILD "PROTECTIVE" SERVICES we will continue to share with the world what is taking place behind your veil of secrecy. And WE WILL open wide the closed doors of the juvenile and family courts ... exposing the criminal and unconstitutional acts of your partners in crime and your co-conspirators! Most importantly, WE WILL NOT BE SILENCED.

The 4-year-old toddler has been identified as Rita Foster. It appears that her death has been declared “nobody’s fault,” according to an initial investigation. A spokeswoman for the Pasadena Police Department said “no one would be cited.” This although Rita had been allowed to ride down a sloping driveway but was “supposed to turn onto a sidewalk,” to avoid a potentially dangerous outcome. So although her care giver allowed her to play Russian roulette with her little life … knowing full well what could happen if she failed to make the required turn onto the sidewalk, no one will be cited ... interesting! Pasadena P.D. spokeswoman, Janet Pope Givens, would also state that there was “no indication that negligence was involved.” GIVE ME A BREAK! Perhaps because the foster “mother” was “exceptionally shaken up,” sympathy is being extended and her clear and obvious negligence is being excused. I guess it pays to be a foster parent and not a biological one!
